Terms and Conditions for Recruiters
1.1. In these Terms & Conditions the following definitions apply:
"Access" means Access-Science Jobs of; BioCity, Pennyfoot Street, Nottingham. NG1 1GF. (Registered Company Number 5204858).
"Jobseeker" the applicant who has registered their details with Access with the intention of finding suitable employment.
"Recruiter" the person, firm or corporate body together with any subsidiary or associated Company as defined by the Companies Act 1985 who has entered a service agreement whereby Access supplies services to that party.
"Website" the Website located on the internet at www.access-sciencejobs.uk where Access promotes its services to both Recruiter and the Jobseeker.
"Advertisement" any promotional material supplied by a Recruiter to display for transmission on the Website.
"Audience" all online visitors to the Website.
1.2. Unless the context requires otherwise, references to the singular include the plural and references to the masculine include the feminine and vice versa.
1.3. The headings contained in these Terms & Conditions are for convenience only and do not affect their interpretation.
2.2. Access complies with the provisions of the Data Protection Act 1998, with regards to the handling of and respect of any Jobseeker information received and will endeavour to keep such information confidential unless requested to do otherwise.
2.3. All copyright, database rights and any other intellectual property rights including material provided on the Website are owned by N2 Resourcing Ltd or its third party suppliers.
2.4. Access does not act or have any relationship as an Employment Agency or business, to provide Employment services on behalf of any Recruiter, Jobseeker or any other user of the Website.
2.5. Services to Recruiters will only commence once a recruiter account has been registered and approved by Access. A username and password will be issued to the registered recruiter, and the services agreed will commence.
2.6. Recruiters are obliged to keep their registered password confidential, and to not disclose to any other person outside of their organisation. Any misuse of the Website under their password will be the responsibility of the registered Recruiter. If Access has reason to believe that a password has been used by an unauthorised person, restrictions may be placed on that password.
2.7. Recruiters must act in a fair and professional manner when contacting and dealing with Jobseekers obtained through the Website, in order to avoid bringing Access into disrepute.
2.8. The Recruiter will indemnify any claim inclusive of legal costs commenced by a Jobseeker against Access which has arisen from a breach of these Terms & Conditions by the Recruiter.
3. Job Posting
3.1. Recruiters are responsible for entering all their own lineage Advertisements online through the Website, unless otherwise stated a vacancy Advertisement can be emailed to Access to be entered on behalf of the Recruiter.
3.2. The Recruiter will reply to the job applicant in a timely and professional manner, and is responsible for any further contact during the recruitment process.
3.3. All Advertisements should be legal, decent and truthful and comply with all applicable advertising laws, rules and regulations.
3.4. Lineage Advertisements may unless otherwise stated contain artwork, logo or design work.
3.5. Any lineage Advertisement containing offensive, obscene or indecent language will be removed from the Website.
3.6. Access may edit or remove any advert which fails to comply with legal or moral obligations, at the discretion on Access.
3.7. The Recruiter may edit, delete or repost any of their jobs at any time within a standard or premium subscription period, by using their online registration details through the Website.
3.8. For the use of Access' own advertising and marketing purposes, the Recruiters' vacancy may be used in support of an Advertisement in outside publications, unless the Recruiter has requested otherwise.
4. CV Search
4.1. This service is available to all Recruiters who have available CV Credits as stated in the service agreement. The Recruiter is able to download Jobseeker CV's via the Website.
4.2. As a Recruiter, you only have access to the database and should be aware that all database rights are owned by N2 Resourcing Ltd. Recruiters should acknowledge that they do not acquire any rights to the database or its content, and its use is governed by these Terms & Conditions.
4.3. Recruiters must only use information from the candidate database for their recruitment activities, and the information should not be supplied or sold to any person or organisation outside of the Recruiter's company.
4.4. The Recruiter must adhere and abide with the Data Protection Act 1998 when handling information regarding candidate's details.
5. Company Banners
5.1. If requested in the service agreement, Recruiters may have an image banner or contextual link Advertisement on the Website. This should be recognised by the Recruiter as a company branding service, and in no way should be confused with specific vacancy advertising.
5.2. If requested in the service agreement, a logo button will be displayed in no particular order on the Website's homepage and will link to either the Recruiters' company profile page or lineage Advertisement on the Website. The logo will be displayed for as long as stated in the service agreement.
6. Jobseeker Newsletter & Job Alerts
6.1. If requested in the service agreement, Recruiters may have an image banner or contextual link Advertisement displayed on the Jobseeker Newsletter or Jobs Alert service. These emails are distributed by Access to all registered Jobseekers who have requested this service.
6.2. All image banners and contextual link Advertisement's will link to either the Recruiters' company profile page or lineage Advertisement on the Website.
6.3. There is no guarantee of the availability of this service, and it is at the discretion of Access to display the image banner or contextual link Advertisement on a rotational basis.
7. Rates & Payment
7.1. The rates for services will be at the discretion between Access and the Recruiter and will be agreed prior to issuing a service agreement. All prices exclude VAT.
7.2. Access will invoice in respect of the fees to the invoice contact detailed on the service agreement. The Recruiter agrees to pay the full invoice amount within 14 days.
7.3. If the Recruiter fails to pay any amount owing after the invoice due date, Access reserve the right to suspend provision of services and to charge interest on the amount owed at the rate of 4% above Natwest Bank Plc's base rate. The invoice due date may be extended with prior agreement at the discretion of Access.
7.4. First job free: this is currently a limited offer for companies who haven't registered on Access before. Upon creating a recruiter account, a job credit will automatically be applied to that account and can be used to post one job for free. There is no obligation to pay any fees or for the Recruiter to continue with the services provided with Access, and can delete their account online at any time. All new recruiter accounts need to be authorised by Access before the job advert can go publicly live. There maybe cases where the Recruiter and/or Advertisement is deemed not suitable for the Audience and therefore Access reserve the right to reject the Recruiter and/or Advertisement.
8.1. If the Recruiter cancels their order at any time within the dates specified in the service agreement, they will remain liable for any outstanding payment owed.
8.2. Either Access or the Recruiter may, at their discretion, terminate the contract at any time by notice in writing to the other party.
8.3. Access has the right to cancel or suspend the Recruiter's services if the Recruiter is in breach of the contract, and fails to remedy such a breach within 7 days of notice from Access.
8.4 Refunds may be given at the discretion of Access.
9.1. Save for any liability which cannot be limited by law, the total liability of the Recruiter shall not exceed £10,000 in the aggregate. Notwithstanding anything to the contrary, neither party shall be liable for any indirect or consequential loss, loss of revenue, profit, data, goodwill, anticipated savings howsoever caused.
10.1. Access hold no responsibility for any loss, delay, damage or costs howsoever caused through the use of the Website.
10.2. It is the liability of the Recruiter to provide adequate and accurate information on any of the Advertisements they have on the Website.
